Terms and Conditions#1-SECURITY DEPOSIT- This deposit may be held by Landlord until inspection of premises by Landlord or his representative at termination of this lease, until all keys are returned by Tenant to NORTH REAL ESTATE and, if applicable, until receipt of all utility bills covering period of this lease are paid in full by Tenant. This deposit is to be used by Landlord to
help defray cost of Tenant damages, needed repairs, and/or replacements. This deposit may also be used to pay for needed cleaning of premise after Tenant departure, any and all unpaid bills arising during the Tenants occupancy. Landlord must advise Tenant in writing and itemize any damages etc., for which money from this deposit is to be withheld. Tenant liability is not limited to the amount of this deposit. Tenant may reasonably expect the return of this deposit within 30-45 days after departing property.
#3 RETURN OF PROPERTY- Tenant shall return property, to Landlord, at termination of lease in as good a state and condition as it was at the beginning of lease period, clean & ready for occupancy. Upon taking control of property tenant should carefully note in writing any deficiencies they may note and give a copy of this list to NORTH REAL ESTATE to be placed in their file, so as to protect their security deposit. This list is due within 72 hours of taking occupancy.
Tenant shall keep grounds in neat order and remove refuse and waste from the premise during, and at end of tenancy.
#4 SUBLETTING- Tenant shall not sublet any part of premise, assign this agreement, or make any alteration of the premise without written consent of Landlord and/or North Real Estate.
#5 LANDLORD INSPECTION- Tenant agrees that Landlord and his agents or representatives may enter the premise at reasonable hours and by prior notice (when possible and within reason) to examine premises, make repairs as necessary, or to show premise for future rent or sale during the term of this lease.
#6 LIABILITY- Landlord & Tenant understand that NORTH REAL ESTATE has not been hired as manager of the premises and that any and all problems arising during the term of the lease may not be within the jurisdiction of NORTH REAL ESTATE and may need to be resolved by Landlord and Tenant, however, NORTH REAL ESTATE will help all parties to this lease as far as is within its power and authority to do so.
#7 LANDLORD LIABILITY- All tenant’s property shall be at sole risk of Tenant. Landlord shall not be liable for damages or losses due to fire, water, defective refrigeration, theft, or otherwise. Tenant is expected to secure Renters Insurance to cover their property, if they so wish.
#8 Smoking not permitted on premises. PETS ARE NOT PERMITTED with out prior consent.
#9 CANCELLATION POLICY: Once a lease is signed and a 20% deposit is received, a tenant will forfeit the 20% deposit in the event they cancel the reservation prior to 30 days before arrival. If tenant cancels reservation within 30 days of the lease start date, and the property cannot be re rented at full price, tenant will forfeit all deposit monies.
#10 TERMINATION OF LEASE- This lease cannot be changed, modified or discharged orally. Tenant should close house per Landlord instructions & return all keys to NORTH REAL ESTATE at termination of this lease. |
